Pineda <br />Director <br />The Division of Reclamation Mining and Safety (Division) has reviewed the 2011 and 2012 Annual Reclamation Reports <br />(ARR) for the New Horizon Mine. The ARR requirements are found in Rule 2.04.13 of the Regulations of the Colorado <br />Mined Land Reclamation Board for Coal Mining and Sections 2.05.4(2)(d) sub - sections 4 and 14, Table 2.05.4(2)(d) -1A, <br />Table 2.05.4(2)(d) -1B and Section 2.05.4(2)(e) sub - section 10 of the New Horizon permit. <br />During the review of these reports, Staff prepared a spread sheet for each year evaluating the review by section. The <br />spreadsheet is organized with the comment number on the far left column, followed by the requirement for each item <br />(rule and /or permit), a short description of the reporting requirement, what was reviewed to fulfill the requirement and <br />lastly staff comments in the last column. Several of the comments require no response. However, there are several <br />items that will need to be responded to. The information provided in the ARR's is used by the Division to monitor <br />reclamation progress and to evaluate bond release applications. The ARR's serve as supporting documentation that the <br />permit requirements are being fulfilled. <br />A copy of the spreadsheets for 2011 and 2012 is attached for your use. The items listed below summarize the <br />comments where a response is requested. The originating comment from the spreadsheet is noted in parenthesis. <br />2011 Annual Reclamation Report <br />1. Please include the title for each attachment and make sure the attachments are correctly titled in the list of table of <br />contents list of attachments. (Comment 1.) <br />2. Please review all maps to include a legend notation for each boundary on the map. The acreage numbers on the <br />map are inconsistent with the acreage number reported in the ARR form and report narrative. Please be consistent. <br />(Comment 4,7, 8, 13, 18.) <br />3. Small inconsistencies noted between the reported seeding acrage and the acreage shown on Exhibit 2011 -4, <br />Seeding. The total PLS on the seed mix printed on Exhibit 2011 -4 is incorrect. The seed mix does not have to be <br />printed on the exhibit, but if it is next year, please check for accuracy. (Comment 7) <br />4. Seed tags for all seed mixes must be included in the ARR. Seeding rates also need to be reported for each seed mix <br />used and for each parcel planted. (Comment 8) <br />5. For the annual weed and pest control activities, please include the dates(s) treatment occurred, report the specific <br />chemicals used and the application rates in the ARR. (Comment 9) <br />6.
