Permit Renewal Application No. 6 (RN-6)

Foidel Creek Mine (Permit No. C-1982-056)

Dear Sir or Madam:

The Colorado Division of Reclamation, Mining and Safety is proposing to approve a renewal
application for coal mining and reclamation permit. The application was submitted by Twentymile
Coal, LLC on November 19, 2012 for the Foidel Creek Mine. In accordance with Rule
2.08.5(3)(b) of the Rules and Regulations of the Colorado Mined Land Reclamation Board for
Coal Mining, we are providing notice of this proposed decision.

Any person with an interest which may be adversely affected by the proposed decision may request
a formal hearing before the Mined Land Reclamation Board within 30 days of the first publication
of the public notice by the Division in the Steamboat Pilot.

The Underground mine is located approximately 23 miles Southwest of Steamboat Springs,
Colorado. The permit area is further described as follows:

The mine permit area is covered by the Cow Creek, Dunckley, Milner, Mount Harris, and Oak
Creek USGS 7.5 minute quadrangle maps and includes portions of Sections 7, 8, 9, T4N, R86W;
Sections 32 and 33, T6N, R86W; Sections 23, 24, 25, 26, 27, 34, 35 and 36 in T5N, R87W; and all
of T5N, R86W with the exception of Sections 34, 35, and 36.

Copies of the renewal application are available for public review in the Division offices at the
above address and at the Routt County Clerk and Recorder. A Copy of the Division's “Proposed
Decision and Findings of Compliance” is also available at those locations.
