Hickenlooper <br />Governor <br />Mike King <br />Executive Director <br />Loretta Pineda <br />Director <br />RE: May Day Idaho Mine Complex, Permit No. M- 1981 -185, Reason to Believe a Violation Exists <br />and Notice of Board Hearing <br />Dear Mr. Rosen: <br />On July 17, 2013 the Colorado Mined Land Reclamation Board (Board) affirmed a stipulated agreement <br />executed by the Division of Reclamation Mining and Safety (DRMS) and Wildcat Mining Corporation <br />(WMC) and ordered that WMC complete repair and stabilization of the new access road, pursuant to the <br />terms approved through TR -2, no later than September 30, 2013. Copies of all relevant stipulation <br />documents are included as Attachments 1 -4 to the September 30, 2013 Inspection Report. <br />On September 30, 2013 the Division conducted an inspection of the site and found that repair and <br />stabilization of the new access road had not yet commenced. The Division believes this a violation <br />pursuant to C.R.S. 34 -32 -124 of the Colorado Mined Land Reclamation Act (Act) for failure to comply <br />with the conditions of a Board order. Therefore the Division has reason to believe that a violation exists <br />to Permit No. M- 1981 -185 and the Law, and has scheduled this matter before the Board. <br />A Hearing will be held during the November 13 -14, 2013 Board meeting for consideration of a possible <br />violation. The hearing will be held at 13'. 3 Sherman Street, Room 318, Denver, Colorado, beginning at <br />9:00 a.m. or as soon thereafter as the matter can be considered. You will have the opportunity to be <br />represented and heard at the hearing. <br />If the Board finds a violation at this hearing, it may issue a Cease and Desist Order, assess a civil penalty <br />in the amount of $100.00 to $1,000.00 for each day of violation and may order the permit to be <br />suspended, modified or revoked. In addition, the Board may set the matter for consideration of forfeiture <br />of the $204,562.00 financial warranty amount held by the Division for Permit No. M -1981 -185 at a <br />subsequent Board hearing. If you have evidence indicating that the possible violation(s) noted above do <br />not exist or have been corrected, please provide it to the Division as soon as possible or, alternatively, <br />bring it to the Board hearing. <br />Following the hearing, all parties have an opportunity to review and comment on a draft of the Board's <br />order before it becomes final. If you wish to do so, you must provide the Board with a written request to <br />review the draft order prior to or at the time of your hearing, or you must inform the Board orally during <br />the hearing that you request to review the draft order. You must include your mailing address and, if <br />possible, a fax or email address.
