Wait <br />Environmental Projection Specialist <br />Division of Reclamation, Mining and Safety <br />Department of Natural Resources <br />1313 Sherman Street, Room 215 <br />Denver, Colorado 80203 <br />Re: Notice of 110(2) Hard Rock /Metal Mining Reclamation Permit Application Consideration Jean Marie Cowman, <br />Agnus Del Lode Clain, File No. M- 2013 -052 (CHS #64667) <br />Dear Mr. Wait: <br />Thank you for your correspondence dated September 10, 2013 (received by our office on September 13, 2013) <br />regarding the subject project. <br />A search of the Colorado Cultural Resource Inventory Database indicates that no cultural resource inventories have <br />been conducted in the vicinity of the proposed permit area and no cultural resources eligible for or listed to the <br />National Register of Historic Places have been recorded therein. Our files contain incomplete information for this <br />area and there is the possibility that as yet unidentified cultural resources exist within the proposed permit area. <br />As this project involves federal oversight from the Pike National Forest, it is the responsibility of the U.S. Forest <br />Service to complete consultation under Section 106 of the National Historic Preservation Act as set forth in 36 <br />CFR Part 800 ( "Protection of Historic Properties "). These duties include the identification of any historic <br />properties (i.e. cultural resources that are eligible to be listed in the National Register of Historic Places) within the <br />area of potential effects and determining whether the undertaking will have an effect upon such properties. The <br />State Historic Preservation Office, Native American tribes, representatives of local governments, and applicants <br />for federal permits, licenses or other approval are entitled to consultative roles in this process. Furthermore, it is <br />the responsibility of the federal agency to disseminate the "findings and determinations made during the Section <br />106 process" to the various consulting parties [36 CFR 800.2(a)(4)]. <br />Thank you for the opportunity to comment.
