Pineda <br />5134 Ute Highway Director <br />Lyons, CO 80540 <br />RE: Silica Quarry; DRMS File No. M -1977 -361; Receipt of 112 Construction Materials <br />Reclamation Permit Application Package <br />Dear Mr. Fischer, <br />On September 4, 2013 the Division of Reclamation, Mining and Safety (Division) received your <br />112 Construction Materials Reclamation Permit Application package for the Silica Quarry, File <br />No. M- 1977 -361. Preliminary review of the information received determined that the following <br />items must be received before the Division can consider your application as being submitted and <br />technical review can begin: <br />Application Form <br />1. The Applicant name was listed throughout the Application Form as `CEMEX Construction <br />Materials South, LLC'. The Division's records show the current Permittee for the Silica <br />Quarry is `CEMEX, Inc.'. The Application Form must be resubmitted with the correct <br />Permittee name (CEMEX, Inc.) listed for all Applicant/Operator fields. Alternately, the <br />Applicant may submit a Succession of Operators Application to transfer the permit from <br />CEMEX, Inc. to CEMEX Construction Materials South, LLC. Upon approval of the transfer <br />of the Reclamation Permit, the review of the Conversion Application for the Silica Quarry <br />could proceed with CEMEX Construction Materials South, LLC listed as the Operator. <br />2. The Applicant has listed the name of the operation as `Cemex Sandstone Quarry'. The <br />Division's records show that the current name of the operation is `Silica Quarry'. Please <br />confirm that you wish to change the name of the Operation to `Cemex Sandstone Quarry' <br />6.4.17 Exhibit Q — Proof of Mailing of Notices to Board of County Commissioners and Soil <br />Conservation District <br />3. The Certified mail receipts which were submitted for proof of mailing of notices to the Board <br />of County Commissioners and the Soil Conservation District were not filled out. Therefore, <br />the Division cannot confirm that these entities received a copy of the mailed notices.
