Reclamation Permit Application Package
Dear Mr. Fischer,
On September 4, 2013 the Division of Reclamation, Mining and Safety (Division) received your
112 Construction Materials Reclamation Permit Application package for the Silica Quarry, File
No. M- 1977 -361. Preliminary review of the information received determined that the following
items must be received before the Division can consider your application as being submitted and
technical review can begin:
Application Form
1. The Applicant name was listed throughout the Application Form as `CEMEX Construction
Materials South, LLC'. The Division's records show the current Permittee for the Silica
Quarry is `CEMEX, Inc.'. The Application Form must be resubmitted with the correct
Permittee name (CEMEX, Inc.) listed for all Applicant/Operator fields. Alternately, the
Applicant may submit a Succession of Operators Application to transfer the permit from
CEMEX, Inc. to CEMEX Construction Materials South, LLC. Upon approval of the transfer
of the Reclamation Permit, the review of the Conversion Application for the Silica Quarry
could proceed with CEMEX Construction Materials South, LLC listed as the Operator.
2. The Applicant has listed the name of the operation as `Cemex Sandstone Quarry'. The
Division's records show that the current name of the operation is `Silica Quarry'. Please
confirm that you wish to change the name of the Operation to `Cemex Sandstone Quarry'

3. The Certified mail receipts which were submitted for proof of mailing of notices to the Board
of County Commissioners and the Soil Conservation District were not filled out. Therefore,
the Division cannot confirm that these entities received a copy of the mailed notices. The
