Box 187 <br />Executive Director <br />Craig, Colorado 81626 <br />Loretta Pineda <br />Director <br />RE: Trapper Mine; C- 1981 -010; SL14 Phase I Bond Release Application <br />Adequacy Review No. 1 <br />Dear Mr. Luke, <br />The Colorado Division of Reclamation, Mining and Safety (Division) received the SL -14 bond release application <br />on May 13, 2013. The application was deemed complete for review on July 18, 2013 and the bond release <br />inspection was conducted on August 15, 2013. As documented in the inspection report, the backfilling and <br />grading has been conducted to achieve approximate original topography. The Division does have concerns about <br />several of the drainages within the requested bond release parcels as discussed below. <br />Drainage Control <br />1.) Each of the bond release parcels are part of a larger watersheds and each drain into an approve sediment <br />control system. Drainages have been reconstructed within several of the parcels requested for bond <br />release. The Middle Pyeatt reconstructed drainage is located within bond release parcel A -B -10. A portion <br />of Oak Gulch drainage is located in parcel A -B -09. The side slopes of these drainages are very steep and <br />have eroded significantly. Check dams have been installed within these drainages and they appear to <br />have helped slow the erosion of these drainages to some degree but the drainages do not appear to be <br />stable. An arm of the East Pyeatt drainage is in the process of being constructed between bond release <br />parcels F -A -12 and Z -A -12. While this channel is not depicted on the 2012 Annual Reclamation Report <br />map, the channel has been excavated and rock has been staged in the channel for check dam construction. <br />The Division and Trapper are currently evaluating the drainage reconstruction and stabilization plan <br />approved in the permit as part of Permit Revision No. 7. In accordance with Rule 4.05.3(1)(3)(4) & (7), <br />channels must be designed, located, constructed, maintained and used to minimize adverse impacts to the <br />hydrologic balance, and to be stable. Given the channel erosion observed during the bond release <br />inspection of the Middle Pyeatt and Oak Gulch reconstructed channels and the future stabilization of the <br />portion of the East Pyeatt channel, these portions of the drainages within the current bond release are not <br />eligible for phase I bond release at this time. A corridor surrounding these drainages will need to be <br />removed from the bond release area for future maintenance and stabilization efforts. Please submit a <br />revised Map 1 for the SL 14 bond release application that excludes the corridors around these drainages <br />from the bond release area. <br />2.)
