The Division has received and reviewed Moffat County Mining, LLC's (MCM) responses to the
Division's preliminary adequacy questions regarding Permit Renewal #6 and has the following
additional comments:

2. Division: Please update Exhibit 42 Ownership & Control Information. The current
ownership and control information provided by Moffat County Mining, LLC is not
consistent with the information in AVS. AVS has Officers and Directors that started their
terms in the years of 2011 and 2012. The current Officers /Directors list has listed officers
in 2009 and 2010. The Division will need an updated list of Officers /Directors from
Moffat County Mining, LLC providing updated end dates for the officers no longer in
office and a new Officers /Directors list with the current officer's names and start dates.
MCM.• Updated Ownership and Control information is provided with these responses for
replacement in Exhibit 42.
