PERMIT #: M -1982 -129 <br />INSPECTOR'S INITIALS: TOD <br />INSPECTION DATE: July 26, 2013 <br />BACKGROUND <br />The Division of Reclamation, Mining and Safety (Division /DRMS) conducted the inspection in responds to a <br />compliance advisory taken by the Colorado Department of Public Health and Environment's Hazardous <br />Materials and Waste Management Division ( HMWMD). DRMS meet with staff from HMWMD and the <br />Goemmer family on June 24, 2013 to discuss HMWMD's compliance advisory. The compliance advisory was <br />held to discuss two pieces of property owned by the Goemmer's where solid waste was illegal being disposed. <br />One of the Goemmer's property discussed in the compliance advisory is located on the west side if Highway 12 <br />almost 2 miles south of La Veta Colorado (parcel No. 22648). This piece of property contains a 9.90 acre sand <br />and gravel pit permit No. M- 1982 -129 this permit is regulated by the Division. The Division conducted the <br />inspection to determine if solid waste was being disposed of within the mining permit boundaries. <br />OBSERVATIONS <br />This was a partial inspection conducted by Tyler O'Donnell of the Division. There was no representative for <br />mine operator present during the inspection. Otto Goemmer the mine operator's representative, was present <br />shortly after the Division conducted the inspection. The Rocky Flat Gravel Pit is located approximately 2 miles <br />southwest of La Veta Colorado. The Rocky Flat Gravel Pit is permitted as a sand and gravel pit. The approved <br />permit area is 9.9 acres. The approved post- mining land use is rangeland. <br />At the time of the inspection it was raining. Portions of the site had standing water due to a rain storm the <br />day before. No mining equipment was operational or present at the time of the inspection. The entire site <br />has been graded to a slope of 4H:1V. A mixture of Grasses and forbs have become established within the <br />majority of the permit area. The Inspector observed piles of solid waste adjacent to the western permit <br />boundary. The Inspector observed some solid waste within the permit boundary. The solid waste within the <br />permit boundary was composed of; woody debris, broken shipping pallets, bricks, and black HDPE pipe. Based <br />on observation most of the solid waste is outside of the approved permit boundaries. This material needs to <br />be removed and disposed of in an appropriate manner. <br />Backfilling and Grading: <br />The site has been backfilled and graded with slopes 4H:1V or flatter. All slopes appeared to be structurally <br />stable. <br />Financial Warranty: <br />The reclamation cost estimate for this pit was updated with this inspection. It was found that the current <br />bond amount is adequate to cover the cost of reclamation. <br />Hydrologic Balance: <br />The site lacks positive drainage, as much of the site is a low area where gravel was mined. The bottom of the <br />former pit was dry, with the exception of the northwest corner. If the operator can prevent storm water <br />impoundment in the northwest corner and establish vegetation that meets the requirements of Rule 3.1.10 <br />then the site may be eligible for final release. <br />Gen. Compliance With Mine Plan: <br />All mining activity appeared to be within the boundaries. The operator is not allowed to dispose of waste <br />within the mining permit. The solid waste will need to be removed and disposed of in an appropriate manner. <br />Page 2 of 9 <br />
