Mike Boulay -6- August 27, 2013 <br />The flume located at the east end of the North Portal upper diversion ditch, <br />consisting of a 36" CMP and concrete headwall, was removed and disposed of. <br />The area was backfilled, graded, extensively roughened, seeded, mulched and <br />tackified. <br />Ponds 6 and 10 were backfilled using material from their respective banks with <br />topsoil hauled in from Topsoil Pile #1. All discharge structures were removed <br />and disposed of. The areas were graded and approved riprap ditches were <br />constructed to convey flow from CRDA #1 and #2 through to Coal Creek. The <br />reclaimed ponds were drill /hydro seeded, mulched and crimped /tackified. <br />Acres submitted for Phase I, II & III release (13.7 acres) <br />• Pond 7, SAE sediment traps and 18" V -ditch were reclaimed and seeded in <br />October 2011. As per rule 3.03.1(5) these acres are considered temporary <br />drainage control facilities and are not subject to the extended liability period of <br />3.02.3(2) or the bond release criteria of 3.03.1(2). <br />• The following areas have been approved in SCC's permit as permanent features. <br />o Haul Roads 1, 2 and 3 <br />o 2 West Portals Access Road <br />o Coal Gulch Current Contours <br />o North Portal Diversion Ditch <br />o Topsoil Pile #2 (remnant) <br />o Coal Creek Current Alignment <br />Acres submitted for Phase II & III release (122.6 acres) <br />The acres nominated for Phase II & III Bond release in this submittal successfully <br />achieved Phase I Bond release on October 27, 2003, with the approval of Bond Release <br />Application No. 2 (SL -02). These acres were seeded with approved seed mixes on or <br />before November 2002, and monitored /sampled as per SCC's permit requirements. <br />Dates and seed mixes for each individual area can be found in Tab 6 of this application in <br />the 2012 Annual Reclamation Report. <br />Cedar Creek Associates, Inc. (CCA) was contract in 2011 and 2012 by SCC to evaluate <br />these acres for Phase III bond release. Sampling was conducted in 2011 and 2012 in the <br />interest of ascertaining the progress toward revegetation success of on the ground <br />revegetation in general accordance with Rule 3.03 and the approved Technical Revision <br />60 (TR -60). The final report, which was submitted to DRMS on May 13, 2013 as part of <br />SCC's 2012 Annual Reclamation Report, includes evaluation of the Greasewood <br />Comparison Revegetation Areas, the Shadscale Comparison Revegetation Areas, and <br />their corresponding reference areas, the Greasewood Reference Area and Shadscale <br />Reference Area. <br />CCA's Introduction, Conclusion and Vegetation Sample Area Location Maps from the <br />"2011 and 2012 Phase III Bond Release Evaluation, Year 1 and Year 2" report are <br />included in this submission. The complete document is on file with Snowcap Coal <br />Company at 2352 North 7th Street, Grand Junction, Colorado and the DRMS Denver <br />office at 1313 Sherman Street, Denver, Colorado. <br />Acres submitted for Phase III release (2147 undisturbed acres) <br />There have been no observed or reported subsidence damage to any of the structures or <br />facilities above the mines. <br />1983 — Settlement was reached and Release was signed by property owners of Powder <br />Mountain Ranch "for any damage which has occurred of may in the future occur to the <br />property which is located in Sections 1 and 2, Township 11 South, Range 98 West of the <br />
