The condition is Stipulation No. 39, which states — "Division approval of <br />permanent retention of Ponds 006, 009, 015, 016, and 017 is conditioned upon approval of their retention <br />by the State Engineer. Documentation of Office of State Engineer approval of ponds 006, 009, 015, 016, <br />and 017 as permanent impoundments, along with documentation that any necessary water rights have <br />been obtained for the impoundments, shall be provided to the Division prior to approval of any bond <br />release application for the impoundments ". <br />The letter from Salt River Project (landowner) and the permanent impoundment demonstration for the <br />following sediment pond are attached: <br />o Pond 005 <br />Also attached are State Engineer approvals for the following ponds and stock ponds: <br />• Pond 005 <br />• Pond 009 <br />• Pond 015 <br />• Stockpond T -2 <br />• Stockpond T -3 <br />• Stockpond T -5 <br />• Stockpond T -18 <br />• Stockpond T -20 <br />• Stockpond T -24 <br />• Stockpond T -26 <br />• Stockpond T -27 <br />Seneca Coal Company • P.O.
