Bo ie experienced a 2.16 inch rain fall event Sunday July 27, <br />2013. This event greatly exceeded the capacity of the ponds to contain the 10 year 24 hour event. Water was discharged <br />over the emergency spillway in great quantities and was not measurable in its volume. This event was also measured as a <br />2.84 inch event at the neighboring West Elk mine. They also recorded a three hour period of time where over an inch of <br />rain fell which approached a 500 year event. <br />Therefore Bowie is claiming the right to exceed permit limits due to extraordinary weather events. <br />Sincerely <br />Wm.
