Langenfeld <br />C -2010 -089 / 'T'R -031 PAR #3 <br />29- Aug -2013 <br />Page 3 of 4 <br />DRMS 08129: The Surface Ownership was revised with the Aug. 26 submittal -- non- <br />contiguous parcels were removed, and contiguous parcels were restored to the list. <br />However, in comparing the names and addresses of the listed parcels with what appears <br />on the Montrose County website (GIS and County Assessor), we found discrepancies in <br />the name and/or address for Parcel Nos. 2 &3, 6, 7, 11, 14, 51, 58, 59, 65, and 67. <br />Please update the ownership and contact information for these parcels, as <br />appropriate. <br />d) The Division has a few corrections /comments to the approved version of 2.03.4(7) <br />(Mineral Ownership) on Pages 9 and 10. Specifically: as this section represents <br />contiguous ownership, No. 6 (WFC) should be removed and No. 49 (Wilcox) should be <br />added. No. 54 (Starks) is listed. The Division is aware that WFC purchased this <br />property. If the Starks retained the mineral ownership, no change to this item is <br />required; if WFC now owns the coal, please delete 54 from the list. <br />DBMS 08/29: Mineral Ownership for No. 49 was added, and No. 54 was deleted., as <br />requested. However, No. 6 was not deleted. Please delete No. 6 from this section; it is <br />already covered under 2.03.4(0 ) (a). <br />e) 2.03.6 -1 on Pages 11 and 12 addresses right of entry. Item 4 addresses the Meehan <br />property. Please update this paragraph to reflect the current status of this parcel. It may <br />be appropriate to retain much of the language, in order to provide a historical reference. <br />DBMS 08/29: Although the historical language was deleted, the revised text does <br />address the Warranty Deed with Meehan. This item is resolved <br />f) Section 2.03. 10 lists the various licenses and permits. Please update the DRMS item to <br />show effective and expiration dates (June 20, 2012 and June 20, 2017, respectively); the <br />Compliance Orders on Consent (with reference to the Appendix); the Discharge Permit <br />Appendix; and the DWR permit information (with reference to the Appendix). <br />DRMS 08129: The DRMS and DWR permit information was updated with the Aug. 26 <br />submittal, and the APCD COC information was provided. Subsequent to the July 17 <br />PAR No. 2, WFC received Initial Approval for the Construction Permit from the <br />APCD. Please update this portion of 2.03.10 to reflect this information. The DWR <br />section was revised to address the SWSP, but the various well permits that have also <br />been issued should also be mentioned, together with their location in the permit. <br />8. Comments on Map 2.03.4 -1 <br />a) The parcel adjacent to the SE corner of the permit area continues to show combined <br />ownership (2 & 3), as does the map table. In light of Item 7c), above, please ensure that <br />ownership of this parcel is consistent throughout the various sections. <br />DRMS 08/29: The County website shows a single owner for this parcel —please <br />update the map accordingly. <br />b) Parcels 9 (Richards) and 43 (Morgan) do not appear on the map, but are listed in the <br />table. <br />DBMS 08/29: Parcels 9 and 43 were removed from the table.
