Repair work to sedimentation control structures <br />took equipment and operators away from daily operations on the gob pile, which has <br />slowed down progress. To further complicate matters and impede progress on the gob <br />pile, the mine is currently mining in a poor quality seam, which generates up to 3,500 <br />tons of gob being hauled to the gob pile on a daily basis. These two factors have <br />slowed down progress. The Operator is still managing the material being brought to the <br />gob pile, and working down the areas that are part of the NOV, but more time is needed <br />to fully abate the NOV. <br />In an effort to improve conditions at Gob Pile #2/ #4, Bowie applied for and was granted <br />enforcement discretion from CDPHE to begin hauling gob to gob pile #3. This step will <br />allow Bowie to divert all gob, at least temporarily to gob pile #3, which will then allow all <br />operations at gob pile #2 to focus on placing and compacting the gob in the NOV area. <br />Hauling gob to gob pile #3 will begin by the middle of September; after the haul road <br />certification and coal mine waste pile certification are submitted and approved by <br />DRMS. <br />It is estimated that about one acre of gob still needs to be placed and compacted in <br />order to achieve final NOV abatement, down from approximately 1.8 acres estimated in <br />the July 30 NOV abatement extension request. The one acre is located at the <br />northeastern most portion of the top of gob pile #2. <br />Between an abatement deadline extension, and the ability to haul gob to gob pile #3, <br />Bowie is confident that they will be able to achieve full NOV abatement by the middle of <br />October.
