I am employed by Wesley D. Conda, Inc., a Colorado corporation, and have knowledge <br />ofthe inforniation contained in this Affidavit. <br />2. Wesley 1). Conda, Inc., and its predecessor Conda Gravel Co., leased the right to mine <br />sand and gravel on the Spicer property located in Section 4, Township 2 South, Range 70 West, <br />6`h P.M., located in Jefferson County, Colorado <br />;. In the course of tnining on said property, Wesley D. Conda, Inc. and its predecessor <br />Conda Gravel Co. mined the pit graphically displayed on Exhibit A attached hereto and made a <br />part hereof located on the Spicer property. <br />4. Mining on the gravel pit depicted on Exhibit A was commenced by Wesley 1). Conda, <br />Inc. and its predecessor prior to January 1, 1981. <br />5.
