Prepared by: Climax Molybdenum Company. Document dated: <br />August 13, 2013. Document received: August 13, 2013. <br />Based on the above referenced correspondence, it is the determination of the Division, and the Division and the <br />Facility agree, that the Facility can meet the requirements for closure of the above referenced adit vent in <br />accordance with 6 CCR 1007 -2, Part 1, the Regulations Pertaining to Solid Waste Sites and Facilities. <br />Furthermore, the Division and the Facility agree to extend the closure deadline date to complete closure activities <br />per the approved November 16, 2012 closure plan to no later than September 1, 2015 with the following <br />conditions. Note, this is the second deadline extension; this first was approved in correspondence dated February <br />4, 2013. <br />1) All structures and protective measures are fully maintained to ensure protection of human health and the <br />environment. <br />2) The adit shaft cannot be used for any disposal of any kind of additional materials. <br />
