The <br />required fee of $257 for this SWSP renewal has been received (receipt no. 3660724). <br />Plan Operation <br />The Heit Sand and Gravel Mine perimeter was lined with a slurry wall in accordance with the <br />State Engineer's Lining Criteria, and was approved by the Division Office on June 24, 2009. In <br />accordance with paragraph 21 of the General Guidelines for Substitute Water Supply Plans for Sand <br />and Gravel Pits, the applicant is required to provide replacement for all native ground water <br />remaining within the lined area that is put to beneficial use except for the water removed with the <br />mined product. The water may be removed from within the lined area and returned to the stream <br />system through surface flow or ground water recharge without need for replacement, so long as the <br />operator does not put the water to beneficial use. Replacement shall be made for native ground <br />water that is lost to evaporation. For purposes of this SWSP, it is assumed that all water within the <br />lined area is trapped native ground water. Therefore, this plan will account for depletions resulting <br />from evaporation of exposed water within the lined area. Operational depletions at the site will <br />consist of water used for dust control and for washing of the mined aggregate using an onsite <br />production well. All water used from the production well must be replaced in time, place and amount <br />including water used for washing of mined product. Total depletions for the Heit Sand and Gravel <br />Mine during the period of this SWSP will be replaced by fully consumable water leased from the City <br />and County of Broomfield. <br />In accordance with the letter dated April 30, 2010 from the Colorado Division of Reclamation, <br />Mining, and Safety ( "DRMS "), all sand and gravel mining operators must comply with the <br />requirements of the Colorado Reclamation Act and the Mineral Rules and Regulations for the <br />protection of water resources. The April 30, 2010 letter from DRMS required that you provide <br />information to DRMS to demonstrate you can replace long term injurious stream depletions that <br />result from mining related exposure of ground water. The DRMS letter identified four approaches to <br />satisfy this requirement. A surety reduction was approved on March 23, 2010 by DRMS reducing <br />the bond by $110,614 — representing the remaining 20% of the construction bond that was posted <br />for the slurry wall.
