A <br />GRAVEL & SAND ROYALTY AGREEMENT <br />OWNER: Gary Boyce <br />Property Description: <br />A tract of land located in the Northwest Quarter (N W' /.) of Section 27, Township 45 <br />North, Range 10 East, New Mexico Principal Meridian, Saguache County, Colorado, <br />more particularly Described as follows: <br />Beginning at a point from which the Northwest Corner of said Section 27 bears N 75 °00' <br />13" W a distance of 1804.99 feet; thence N 90 °00'00" E a distance of 761.20 feet; thence <br />S 00 °00'00 "E a distance of 741.19 feet; thence N 75 °00'00" W a distance of 379.08 feet; <br />thence N50 °00'00" W a distance of 460.00 feet; thence N 07 °00'00" W a distance of <br />350.00 feet to the True Point of Beginning, containing 9.994 acres, more or less. <br />Together with an easement 60 feet in width for ingress and egress to the above parcel, the <br />centerline of said easement is described as follows: Beginning at a point on the south <br />right -of -way line of County Road CC from which the northwest comer of Section 27 <br />bears N 88 °54' 18 "W a distance of 2157.97 feet; thence S 00 °00'00" E a distance of <br />425.81 feet to the north line of the above described parcel. It is intended that the sides of <br />this easement be lengthened or shortened to intersect the parcel and the county road RO- <br />W. <br />Hereafter referred to as COTTON CREEK PIT <br />Whereas the owners of this property have entered into an agreement with Ken Skoglund, <br />dba SKOGLUND EXCAVATING, for said SKOGLUND EXCAVATING to mine <br />material from the above described tract and hereby grant unto said SKOGLUND <br />EXCAVATING the right to enter said premises for this purpose and to remove said dirt, <br />sand and gravel. In return, said SKOGLUND EXCAVATING agrees to pay a royalty <br />based on the cubic yards removed from the site.
