PERMIT #: M- 2009 -027 <br />INSPECTOR'S INITIALS: TOD <br />INSPECTION DATE: August 19, 2013 <br />OBSERVATIONS <br />This was a follow -up inspection, conducted by Tyler O'Donnell of the Division of Reclamation, Mining and <br />Safety (Division). Gary Vezzani, the mine operator's representative, was present during the inspection. The <br />WSG - Hribar Pit is located approximately 10 miles northwest of Walsenburg Colorado. The WSG - Hribar Pit is <br />permitted as a sand and gravel pit. The approved permit area is 9.99 acres. The approved post- mining land <br />use is rangeland. <br />The sky was clear and the ground was dry. The site was operational during the inspection. The mining <br />operation appears to be progressing from north to south. There were multiple stockpiles of product along the <br />northern edge of the permit boundary. <br />The primary purpose of the follow -up inspection was to verify the location of the boundaries markers. During <br />the inspection, the field- identified permit boundaries were collected using a hand held GPS unit. The Division <br />determined the field- identified boundaries contain approximately 16.5 acres. The affected area was also <br />measured with the hand held GPS unit and was found to be approximately 14.5 acres. <br />C'nnelncinn <br />Based on observations made during the inspection, the Division believes the boundary markers are incorrectly <br />placed. Based on the GPS data collected during the inspection the operator has disturbed 4.5 acres more than <br />what is currently approved in the 110c permit. However, no reclamation permit was issued prior to the <br />commencement of the mining operation on lands outside of the approved permit boundary. Therefore, the <br />Division has Reason to Believe a violation of C.R.S. 34 -32.5 -109 (1) has occurred and will schedule the matter <br />for consideration by the Mined Land Reclamation Board, to occur during the September 18 -19, 2013 Board <br />meeting. The Board meeting will occur at 1313 Sherman Street, Room 318, Denver, Colorado. Official notice <br />of the September 18 -19, 2013 Board meeting will follow under separate correspondence addressed to The <br />Walsenburg Sand and Gravel Company.
