The Division has reviewed Energy Fuels Coal Inc.'s submittal of Minor Revision No. 61 and has
the following questions regarding the proposed changes to Table 11 and Table 15.
On Table 11, Well Permits for permit and adjacent areas -Part 1: Loadout, the well permit
in Township 19S, Range 60W, NW' /4 NE' /4 Section 17 issued to G. Romonito indicates
that the well permit was issued 12/31/2012. Verification with the Colorado Divison of
Water Resources database finds that this well permit was issued 12/31/1912, and
subsequently cancelled 1/15/1998. Please correct the table accordingly.
2. On Table 11, Well Permits for permit and adjacent areas -Part 2: Mine Area, the well
permit for P. Thompson located in Township 20S, Range 70W, SE' /4 NW' /4 Section 25
lists the issue date as 12/22/2008. The Division of Water Resources database, and other
portions of the Southfield mine permit note that this well was first used in 1941. Please
correct this information in the table as well.
On Table 11, Well Permits for permit and adjacent areas -Part 2: Mine Area, well permits
for Dorchester Coal located in Township 20S, Range 70W, SE' /4 NW' /4 Section 25 lists
the issue date as 12/22/2008. The Division of Water Resources database indicates that
these permit applications were either issued or denied 2/22/1980. Please correct Table 11
accordingly.
4. Table 15 provides information pertaining to surface water rights. Some of the changes to
Table 15 that do not seem to fit with the previous information EFCI had provided to the
Divison:
a) City of Florence, Section 20, Township 70S, Range 36w, Source: Newlin Creek.
The Divison believes the Range is incorrectly reported. The Township and Range for
Newlin Creek would be T20S, R 70W. The reported range of 36W would place this
surface water right in eastern Colorado. Please corrected accordingly.
