Al would like to clarify that the revision request is for minor <br />changes to the currently approved reclamation of the area generally referred to in the permit documents as <br />the North Lake. The request does not seek Division approval of easements granted by Al as owner of the <br />property to Metro Wastewater Reclamation District (Metro). As owner of the land, it is AI's right to sell, let <br />or grant rights of way and easements without Division consent. <br />As indicated in the revision request, the easements granted Metro are associated with their Northern <br />Treatment Plant project. A portion of the 7 -mile long South Platte Interceptor pipeline associated with that <br />project will be constructed within the easements on AI's property. Al has granted easements for pipelines, <br />electrical services, and other utilities on its mining properties to various entities in the past, and we are not <br />aware of any authority that the Division has with regard to location, design and construction of any structures <br />or work associated with purpose(s) for which easements are granted. <br />The terms of the easement agreements, which are recorded and of public record, contain specific location <br />information. The easement agreements also provide for restoration of areas disturbed in association with the <br />installation of the structure(s) for which the easements are granted. In this particular instance, the <br />agreements also provide for restoration of areas outside of the permanent utility easement. <br />Based upon the above, Al responds to the Division's adequacy comments as follows (Al responses in bold <br />following each Division comment) : <br />1) The post mining land use under Amendment #2 and approved on October 3, 2002 is for the site to be <br />developed as recreation areas, with developed water resources of wetlands and lakes. How does a <br />waste water treatment facility and sanitary sewer pipe line meet this post mining land use, if the <br />construction is prior to release of site from reclamation responsibilities?
