Division Response: Based on a second review of the ownership and control section of
the currently approved permit application package for the Foidel Creek Mine, comparing
the section with the current information in the Applicant violator System (AVS), there are
three remaining discrepancies that will need to be addressed by Twentymile Coal. Please
address the following discrepancies listed below:
a. For American Land Holdings of Colorado, LLC the following person is listed
in AVS but not listed on the Directors /Officers Report: Keith R Haley as Vice
President beginning on 03/06/2013. The following person is listed on
Directors /Officers Report but not listed in AVS: Marc E Hathhorn as Vice
President beginning on 09/10/2012.
b. For American Land Development, LLC the following persons are listed on
AVS but not listed on the Directors /Officers Report: Mary L Frontczak as
Assistant Secretary beginning on 09/10/2012. Kurt A Jones as Assistant
Treasurer beginning on 09/10/2012.
c. For Peabody Investments Corp the following persons are listed on AVS but
not listed on the Directors /Officers Report: Allen T Capdeboscq as Vice
President of Financial and Capital Planning beginning on 09/10/2012.

2. Division Initial Comment: It appears that surface and mineral ownership and Right of
Entry information may be out of date in section 2.03 and on Maps 01 and 02. Please
provide an updated list and Maps of all owners of both surface and mineral property to
include updated documents that the applicant bases his or her legal right to enter.
TC Response: The referenced permit text section and maps have been reviewed and
updated, as appropriate, to reflect current ownership. Copies of the revised pages and
Map 1 accompany these responses for replacement in the PAP.
