• SURFACE LANDOWNER' CONSENT <br />I, Peter B. Lilly certify that Powderhom Properties Company (PPC) <br />holds surface rights on certain land on which Powderhom Coal Company (Powderhom) has <br />made application for Mining and Reclamation Permit No. C-81-041 with the Colorado Division <br />of Minerals and Geology. PPC's surface ownership within Powderhom`s permit boundary <br />include the following: <br />Township 10 South, Range 98 West, 6PM, Mesa County Colorado: <br />Portions of the SWl/4, Portions of the SWl/4NW1/4 Section 26 <br />Portions of the SE1/4SW1/4, SW1/1SW1/4, N1/2SW1/4, Wl/2NW1/4,.NW1/4NE1/4, <br />SI/2NE1/4, No/2SE1/4, SWl/4SE1/4 Section 27 <br />Portion of the SE1/4, NEl/4, SWI/4, E1/2NW1/4 Section 28 <br />Portions of the SEl/4NW1/4, Portions of the El/2SW1/4, Wl/2SE1/4, Portions of the <br />E1/2SE1/4 Section 34 <br />Township 11 South, Range 98 West, 6PM, Mesa County Colorado: <br />Lots 3 and 11 Section 1 <br />• I have examined the current mining and reclamation plan prepared by Powderhom and in <br />compliance with the Colorado Division of Minerals and Geology's Rule 2.05.5(1)(b), do hereby <br />approve of the provisions of the plan relative to the above described land. Also, in accordance <br />with the Colorado Division of Minerals and Geology's Rules 4.03.1(1)(f) and 4.03.2(1)(g), I do <br />hereby request that the portion of Hauh.Boads_3&4, Access Road 28c3 and Light Use~Road 1 <br />which cross the above described land and as shown on the attached diagrams be left in place <br />subsequent to mining and reclamation operations. With the exception o aul Road 2, these road <br />._. <br />have been used prior to and concurrent with Powderhom's operation for gene access to this <br />and adjacent land. The roads will continue to be used for this purpose. Haul Road 2 will be used <br />for~access to land' between the railroad tracks and the River.
