Hickenlooper <br />Governor <br />Mike King <br />Executive Director <br />Dick Wolfe, P.E. <br />Director /State Engineer <br />RECEIVED <br />4UG n 8 2013 <br />This letter is in response to your application of May 15, 2013 requesting aVV4AWa&4 <br />supply plan ( "SWSP ") for a sand and gravel pit, known as the Sievers Pit, to be operated by <br />Oldcastle SW Group, Inc. ( "Oldcastle" or "Applicant ") in accordance with § 37 -90- 137(11), C.R.S. <br />The Applicant shall be responsible for compliance with this SWSP, but the State Engineer's Office <br />may also pursue the landowner, for eventual compliance. The mine is permitted with the Division <br />of Reclamation, Mining, and Safety under File No. M -77 -098. The $257 fee has been accepted <br />with receipt no. 3660068. <br />Plan Operations <br />The Sievers Pit is located in Section 18, Township 7 South, Range 88 West of the 6th P.M. <br />and it currently operates pursuant to an augmentation plan that was decreed on July 25, 1984 in <br />Case No. 83CW65. Oldcastle recently acquired the mine site from Lafarge West Inc. ( "Lafarge ") <br />and proposes to continue mining under the DRMS Permit no. M77 -098. Also Oldcastle proposes to <br />expand mining and water uses beyond the decreed amounts outlined in Case No. 83CW65. This <br />SWSP will replace depletions incurred by the expansion only. This SWSP will work in conjunction <br />with the above referenced augmentation plan to replace depletions from exposed groundwater, <br />dewatering, and operational uses. The expansion of the mining at Sievers Pit began in July 2009. <br />Over the next year the exposed groundwater will be within the dewatering trench and ponds. <br />In accordance with the letter dated April 30, 2010 (copy attached) from the Colorado <br />Division of Reclamation, Mining, and Safety ( "DRMS "), all sand and gravel mining operators <br />must comply with the requirements of the Colorado Reclamation Act and the Mineral Rules <br />and Regulations for the protection of water resources.
