STATE OF COLORADO <br />COLORADO DEPARTMENT OF PUBLIC HEALTH AND ENVIRONMENT og cow <br />AIR POLLUTION CONTROL DIVISION F� <br />TELEPHONE: (303) 692 -3150 <br />CONSTRUCTION PERMIT *1876* <br />PERMIT NO: 93RB1171 F <br />FINAL APPROVAL <br />DATE ISSUED: APRIL 15, 1998 Modification #1 <br />ISSUED TO: BLUE MOUNTAIN ENERGY, INC. - Deserado Mine <br />THE SOURCE TO WHICH THIS PERMIT APPLIES IS DESCRIBED AND LOCATED AS FOLLOWS: <br />Surface activities connected with underground mining of bituminous coal at Deserado Mine <br />located in portions of Sections 22, 23, 26 & 27, in T3N, R101W, approximately 13 miles <br />east of Rangely, near County Road #65, in Rio Blanco County, Colorado. <br />THE SPECIFIC EQUIPMENT OR ACTIVITY SUBJECT TO THIS PERMIT INCLUDES THE FOLLOWING: <br />Operation, Reclamation, Restoration and Revegetation of a 66 -acre Refuse Pit No. 5. This <br />pit will be used for disposal of coal refuse from processing plant. <br />THIS PERMIT IS GRANTED SUBJECT TO ALL RULES AND REGULATIONS OF THE COLORADO AIR <br />QUALITY CONTROL COMMISSION AND THE COLORADO AIR QUALITY CONTROL ACT C.R.S. (25 -7 -101) <br />et sea), TO THOSE GENERAL TERMS AND CONDITIONS SET FORTH ON THE REVERSE SIDE OF THIS <br />DOCUMENT AND THE FOLLOWING SPECIFIC TERMS AND CONDITIONS: <br />1. This permit is exclusively for activities directly connected with the operation, restoration and <br />revegetation of Refuse Pit No. 5 (designated as RP -5). All other activities, including hauling in of <br />refuse must have separate permits. <br />2. The particulate emission control measures listed on Attachment A (as proposed in the Particulate <br />Emission Control Plan submitted to the Division) shall be applied to the particulate emission <br />producing sources as required by Regulation No. 1. <br />3. Adequate surface moisture shall be maintained to effectively suppress fugitive dust emissions. <br />4. At all times, including periods of start -up, shutdown, and malfunction, the facility and control <br />equipment shall, to the extent practicable, be maintained and operated in a manner consistent with <br />good air pollution control practices for minimizing emissions. Determination of whether or not <br />acceptable operating and maintenance procedures are being used will be based on information <br />available to the Division, which may include, but is not limited to, monitoring results, opacity <br />observations, review of operating and maintenance procedures, and inspection of the source. <br />5. A Revised Air Pollutant Emission Notice shall be filed when a significant change in emissions <br />occurs, as required by Regulation No. 3. <br />103/0014/008 <br />
