STATE OF COLORADO <br />COLORADO DEPARTMENT OF PUBLIC HEALTH AND ENVIRONMENT oe•co� <br />AIR POLLUTION CONTROL DIVISION �Q <br />TELEPHONE: (303) 692 -3150 y <br />CONSTRUCTION PERMIT *,8,6* <br />PERMIT NO: 12RB802 -1 F <br />FINAL APPROVAL <br />DATE ISSUED: APRIL 15, 1998 Modification #2 <br />ISSUED TO: BLUE MOUNTAIN ENERGY, INC. - Deserado Mine <br />THE SOURCE TO WHICH THIS PERMIT APPLIES IS DESCRIBED AND LOCATED AS FOLLOWS: <br />An underground coal mine known as D portal and associated equipment to produce 1,600,000 tons <br />of coal annually located approximately 7 miles northeast of Rangely, Rio Blanco County, Colorado. <br />THE SPECIFIC EQUIPMENT OR ACTIVITY SUBJECT TO THIS PERMIT INCLUDES THE FOLLOWING: <br />Emergency stockpile: 30,000 ton maximum capacity including front -end loading, rear dump <br />unloading and stockpile maintenance activities. <br />THIS PERMIT IS GRANTED SUBJECT TO ALL RULES AND REGULATIONS OF THE COLORADO AIR <br />QUALITY CONTROL COMMISSION AND THE COLORADO AIR QUALITY CONTROL ACT C.R.S. (25 -7 -101) <br />et sea), TO THOSE GENERAL TERMS AND CONDITIONS SET FORTH ON THE REVERSE SIDE OF THIS <br />DOCUMENT AND THE FOLLOWING SPECIFIC TERMS AND CONDITIONS: <br />1. Maximum size of stockpile shall not exceed 30,000 tons emergency storage during the operation <br />of the mine. <br />2. This stockpile shall not exceed the following emissions of fugitive total suspended particulates <br />(TSP). The Division assumes that these levels are being met if the control measures stated in the <br />approved control plan are followed and the stated process rates are not exceeded. <br />Total Suspended Particulates:.......... 4.7 tons per year <br />3. The particulate emission control measures listed on the attached page (as approved by the Division) <br />shall be applied to the particulate emission producing sources as required by Regulation No. 1, <br />Section III.D.1.b. <br />4. In accordance with C.R.S. 25 -7- 114.1, the Air Pollutant Emission Notice (APEN) associated with <br />this permit is valid for a term of five years. The five year term for the APEN received with this <br />permit application expires on November 26, 2001. A revised APEN shall be submitted no later than <br />30 days before the five year term expires. <br />103/0014/002 <br />
