I. LEGAL, FINANCIAL, COMPLIANCE AND RELATED INFORMATION <br />Blue Mountain Energy, Inc. (BME) operates an underground coal mine, the Deserado <br />Mine, on federal coal leases that BME controls in Rio Blanco County, Colorado. BME <br />operates this mine under Colorado Division of Minerals and Geology permit No. C -81 -018. <br />Figure 1 -1 is a general location map showing the permit area. The first mine permit was <br />issued on July 27, 1981 for an eight -year term, three years for construction and five years <br />for operation. The permit was renewed on July 27, 1989, July 27, 1994, July 27, 1999, <br />July 27, 2004, and July 27, 2009. The name of the permittee was changed on October <br />16, 1996 from Western Fuels Utah, Inc. to Blue Mountain Energy, Inc.
