PERMIT #: M- 2013 -041 <br />INSPECTOR'S INITIALS: TOD <br />INSPECTION DATE: July 31, 2013 <br />OBSERVATIONS <br />This Inspection occurred to evaluate an unpermitted mining activity at the Thank You Lord claim in Chaffee <br />County. The inspection was conducted by Tyler O'Donnell and Michael Cunningham of the Division of <br />Reclamation, Mining and Safety (Division /DRMS). Brain and Yolanda Busse the claim holders of the Thank You <br />Lord claim were present during the Inspection. <br />The Thank You Lord claim (CMC28002) is located on the southwest side of Mount Antero on a steep talus <br />slopes above the Baldwin Gulch drainage. The Thank You Lord claim is located at approximately 12,400 feet <br />above sea level. The Thank You Lord claim was accessed by foot from forest service road 278 just below dead <br />man's corner. <br />The operator's representative explained that they have had the claim for approximately nine years. The <br />operator's representative explained that they use hand tools to dig a series of benches and sift through the <br />material looking for Aquamarine gemstones. The Division observed a series of benches located below a <br />granite outcrop. The Division observed a variety of hand tools and screens on top of the benches where <br />mining activities have occurred. The Division observed portions of the benched workings that have been <br />backfilled and graded. During the inspection, the area of the mining - related disturbance was measured with a <br />hand held GPS unit and was found to be approximately 0.37 acres. The mining - related disturbance on the site <br />covers an area which is approximately 215ft long by 80ft wide. The mining - related disturbance is comprised of <br />a benched area at the top of the site, and an overburden /waste rock pile below the benched workings (see <br />Figure 1 and photos 1). <br />Conclusion <br />Pursuant to C.R.S. 34 -32- 109(7) of the Colorado Mine Land Reclamation Act, 34 -32 et seq., the activity <br />conducted on the site appeared to constitute a mining operation. However, no reclamation permit was issued <br />prior to the commencement of the operation. Therefore, the Division has reason to believe a violation of <br />C.R.S. 34 -32- 109(7) has occurred and will schedule the matter for consideration by the Mined Land <br />Reclamation Board, to occur during the August 14 -15, 2013 Board meeting. The Board meeting will occur at <br />1313 Sherman Street, Room 318, Denver, Colorado. Official notice of the August 14 -15, 2013 Board meeting <br />has been sent under separate correspondence addressed to Brain and Yolanda Busse.
