PERMIT #: M- 1985 -218 <br />INSPECTOR'S INITIALS: TC1 <br />INSPECTION DATE: July 25, 2013 <br />OBSERVATIONS <br />This inspection was initiated by a request for Temporary Cessation. The purpose of this inspection was to check <br />compliance of the operation with the requirements of the Act, Rules, and the conditions of the permit. Rusty <br />Cochran was present during the inspection representing the Operator. This site is located approximately nine <br />miles east of Pueblo, in Pueblo County. The site is south of US Highway 50 on the north bank of the Arkansas <br />River. <br />Inspection: <br />The Permit sign and boundary markers were properly posted (Photo 1). There has been no activity on site since <br />the previous inspection other than some asphalt recycling near the entrance (Photo 1). <br />There is growing number of tamarisk in the vicinity of the main pit lake. These plants appear to be a sink, given <br />the proximity to the Arkansas River and the large tamarisk along the river bank. This Inspector recommended <br />to Mr. Cochran that the larger tamarisk be removed. <br />Current Stipulations: <br />None. <br />Records: <br />The previous inspection was conducted 4/10/2012. Two problems were cited requiring a slurry wall <br />design and additional bond. These were both resolved in May of 2012. <br />Division records indicate a substitute water supply plan was approved by the Division of Water <br />Resources through March 31, 2013 for the exposed groundwater on site. <br />The permit anniversary date is June 15. The operator is current with annual fees and reports through <br />2013. <br />Bond: <br />The current financial warranty is a $344,500 corporate surety and is deemed adequate based on the 2012 bond <br />calculation. <br />Summary and Recommendations: <br />1. The previous substitute water supply plan (SWSP) expired at the end of March 2013. The OPERATOR <br />needs to renew /amend the SWSP with the Division of Water Resources. The OPERATOR should also <br />verify all water rights necessary for the SWSP were transferred to the OPERATOR during the transfer <br />of the property. The source of replacement water is the Arkansas Groundwater Users Association <br />(AGUA). <br />2. The OPERATOR shall commit to removing the larger tamarisk plats in the vicinity of the main pit lake. <br />Page 2 of 3 <br />
