August 1, 2013 <br />Ms. Janet Bums — Reclamation Specialist <br />Colorado Division of Reclamation Mining & Safety <br />1313 Sherman St — Room 215 <br />Denver, CO 80203 <br />RE: Technical Revision No.40 (TR -40) - Southfield Monitor Well MW -NW <br />Energy Fuels Coal, Inc. — Permit No. C -81 -014 — Southfield Mine <br />Dear Janet Binns: <br />As a result of obtaining additional hydrologic information and support data pertaining to the monitor well <br />MW -NW in the context of the Southfield mine's hydrogeology, EFCI submitted a revised version of <br />Technical Revision No. 40 (TR -40) on July 25, 2013 to the Division. The TR was filed in response to <br />NOV No. CV -2013 -002 which sited EFCI for failing to ensure that monitoring well MW -NW continued <br />to function as designed. The NOV is currently on appeal to the Mined Land Reclamation Board (the <br />"Board "). <br />Given that the research, modeling data and support material submitted in TR -40 is quite extensive, EFCI <br />understands that the Division requires adequate time to review, evaluate and respond to the Revision in a <br />reasonable time frame. <br />Accordingly, EFCI requests that the scheduled Mined Land Reclamation Board Hearing currently <br />scheduled for August 14, 2013, be postponed and rescheduled for the October 16, 2013 Board Hearing <br />date. <br />If you have questions or require further information, please contact me. <br />Sincerely, <br />George V Patterson <br />Energy Fuels Coal, Inc <br />
