There are <br />several deficiencies in the response that will need to be addressed prior to the Division's approval of TR10 /RN4. <br />The items from the 3rd adequacy review are listed below and are italicized along with a description of your <br />response and the current status of these items. <br />Adequacy Review No. 3 Response Review: <br />Tab 03; Adjudication file <br />Your response to item #3 of the Division's first adequacy review letter indicates that included with your <br />adequacy review response letter was your most up to date copy ofpage 3 -1.1 ofAppendix 3 -1. However, only <br />the "Permit Area Legal Description Summary" sheet was included with the revised pages and your copy of <br />page 3 -1.1 was not included. Please submit your revised copy of page 3 -1.1 ofAppendix 3 -1. <br />Response /status: Your response letter indicates that you do not have a copy of page 3 -1.1 of <br />Appendix 3 -1. During the adequacy review for Permit Renewal No. 4 (RN4), there was a small <br />discrepancy in acreage listed on the page in question. The Division made note of this discrepancy <br />and indicated that this page was missing from the electronic copy of the permit. Based on your <br />response letter, it appears that this page is also missing from your copy of the permit. However, the <br />Division's hard copy of the permit included a copy of this page. Enclosed is a copy of page 3 -1.1, <br />please add it to your copy of the permit, it is the first page of the legal description of the original <br />permit area and should be included. <br />2. The response to item #4 of the Division's first adequacy review letter does not address the permit deficiency <br />the Division noted in that item. Rule 2.03.6 states, "Each application shall contain a complete and detailed <br />legal description of the proposed permit boundary ". Appendix 3 -1 contains a detailed legal description of <br />the original Hayden Gulch Loadout permit boundary but does not include a detailed legal description of the <br />Tie Across Haul Road. Please submit a copy of the detailed legal description for the Tie Across Haul Road <br />to be included in Appendix 3 -1 in order to comply with Rule 2.03.6 <br />a. Response /status: Your response letter indicates that HGL is researching the Routt County Records <br />and will submit the information as soon as it is completed.
