Findley, Director' <br />Water Division, Raglan x <br />Thank you for your memorandum dated April 24, 1999, se*Xing <br />Headquarters assistance in resolving a disagreement betwe4n the <br />Raglan and the U.S. Army Corps of rnginaers (Corps) North Pacific <br />Division regarding Clean water Act permits for two mining <br />Divlilon in Asagree overothe rotdsiot�$action *Ranand d4404 in <br />regulating the disposal /treatment of Ring tailings in vast* <br />treatment systems created in voters of the united States. <br />Wetlands Division staff have discussed this natter with <br />rohn Studt, Chief of the'Regulatory Branch at Cords seadquarters. <br />As explained below, we have reached agreement wilt Mr. Studt on <br />the Appropriate permitting approach for the A-.T Mine and <br />Kensington Nine proposed projjects# and he will be notifying the <br />North Pacific oivisia► of Corps Headquarters' position on this <br />iasus shortly. In resolving this matter, the Wetlands Division <br />has also coordinated with the ottiee of General Counsel and the <br />Permits Division of the Office of Wastewater Enforcmsont and <br />Compliance (OWEC). <br />It is our understanding that the Alaska District hem two <br />KXansingtonprojeots,ar sppectively. crThe oompanias• ere s�wltinq <br />section 404 permits to discharge fill material in waters of the <br />United $tat*@ in order to create basins for the disposal and <br />treatment of sine tailings. All the parties agree that the <br />mining companies need a Section 404 persit for the discharge of <br />fill material to create the basing themselves, and that a section <br />402 permit is needed for any discharges flowing out of the basins <br />following treatment.
