Peabody operates pursuant to an approved mine plan, <br />Permit No. C- 2009 -087 (the "Mine Permit "), which specifically includes sediment ponds to treat <br />mine runoff and wetlands which are well within the Mine Permit boundary. In 2013, Peabody <br />requested and received from DRMS a minor revision to its Mine Permit to use the wetlands below <br />Pond 002 as part of the treatment facilities and enhance the treatment functions of those wetlands <br />below Pond 002.
