Response:
The historically disturbed area has been labeled on Exhibit Map E -1A, both on the permit area and in
areas adjacent to it.
Comment 6 The second sentence indicates no diversion or other on -site runoff control will be
created. Please see Comment 7 below and correct this statement
Response:
See response to Comment 7 regarding ore. An erosion and runoff control map will be drafted per
discussions with CDPHE.
Comment 7 Exhibit T discusses the potential for unoxidized ore... a statement needs to be
included as to the potential impact on surface water...
Response:
Exhibit C notes that the ore material will be stored underground in an ore bin. It goes on to say that the
material will then " ... be hauled to the portal for temporary storage." At the portal, it is anticipated
that ore will be loaded directly out of the mine onto trucks, and as a result, there will be no surface
storage of sulfide ores. Further, the words "iron sulfide" was used in the permit application to be
complete and consistent with the company's hopes that future exploration might identify sulfide ores.
However, at this time, the project is still in exploration stage, and not yet in production mining stage,
and exploration, so far, has not yet identified any sulfide- containing vein material that can be classified
as ore. Since no sulfide ore currently exists, and that if any is ever found, it will most likely not be stored
outside in the weather. In the event sulfide ore is found, and outside storage becomes an option, then
steps will be taken to provide the Division of Reclamation, Mining, and Safety (DRMS) with engineering
designs to properly contain any runoff water and to protect the environment.
Comment 8 Rule 6.3.3(1) requires a narrative on what measures will be taken to minimize the
disturbance to the prevailing hydrologic balance. In reference to the potential stockpiling of
unoxidized ore please address this requirement.
Response:
The pre -110 permit hydrologic balance will be approximately maintained. The only anticipated
modification will be some decrease in pre- mining surface runoff. Berms around the travel areas serve to
pool precipitation on the level areas instead of allowing it to run off. This, along with a series of
sediment retention areas located along the road surface will produce a decrease in instantaneous
surface flows off of the disturbed areas, along with a decrease in suspended solids. Based on the
Technical Release No 55 data, run -on is anticipated to be minimal and if it occurs, it will be directed into
