7/30/13 State.co.us Executive Branch Mail - Bowie No. 2 Mine C1996083 NOV CV2013004
Burgmaier - DNR, Susan <susan.burgmaier @state.co.us> Mon, Jul 29, 2013 at 3:52 PM
To: Tamme Bishop <tamme.jestover @bresnan.net >, Bill Bear <BBear @bowieresources.com>
Cc: Alysha Hernandez - DNR <alysha.hernandez @state.co.us >, Sandy Brown - DNR <Sandy.Brown @state.co.us>
Tamme and Bill - We flew Bowie 2 on Tuesday, July 23, 2013. It looks like BRL has made considerable progress
with the grading and compaction of the previously end - dumped gob material, but there is still some material in the
central portion of the pile that will need to be graded and compacted to completely abate the NOV. In the
attached photo, the area that still needs to be compacted is a triangular area roughly bounded by the two
excavators in the center of the pile and the dozers and compactors on the northeastern portion of the pile, and
also the area due west of the white pickup truck. Please call me if the areas I'm describing are not clear to you.
It looks likely that this will not be completed by July 31, 2013 (the current abatement due date), but it does look
like significant progress has been made. If BRL would like to request an extension of the abatement deadline,
the Division will consider extending it. Please note that any extension request beyond 90 days (August 14,
2013) would require approval by the Director under the specific circumstances set forth in Rule 5.03.2(2)(c).
Susan L.
