( "Coulson" or "Applicant") In accordance with <br />Section §37 -90- 137(11), C.R.S. The Applicant shall be responsible for compliance with this plan. <br />The required fee of $257 for the substitute water supply plan has been submitted (receipt no. <br />3653131C). <br />Plan Operation <br />This plan seeks to replace depletions resulting from mining at the Brownwood Gravel Pit <br />( "Brownwood Pita). Brownwood Pit is located in the E1/2 of the SE1 /4 of Section 19, Township 5 <br />North, Range 68 West of the 6t" P.M. Mining at this site has been completed and the site is <br />currently undergoing final reclamation, The south east cell has been lined and was approved <br />as a lined reservoir (WDID 0403398) by the State Engineers Office through a letter dated <br />October 4, 2012. As part of the reclamation efforts backfilling has occurred in the groundwater <br />pond so that 13.0 acres of exposed ground water remain within the DRMS permit boundary. <br />There are no ground water areas within the DRMS permit boundary that were exposed prior to <br />January 1, 1981, <br />In accordance with the letter dated April 30, 2010 (copy attached) from the Colorado <br />Division of Reclamation, Mining, and Safety ( "DRMS "), all sand and gravel mining operators <br />must comply with the requirements of the Colorado Reclamation Act and the Mineral Rules and <br />Regulations for the protection of water resources. The April 30, 2010 letter from DRMS <br />requires that you provide information to DRMS to demonstrate you can replace long term <br />injurious stream depletions that result from mining related exposure of ground water, In <br />accordance with approach no. 4 you have dedicated 0,24 shares of the Big Thompson Ditch & <br />Manufacturing Co. water rights to this SWSP, and up to the entire 5/6 of a share in the Big <br />Thompson Ditch & Manufacturing Cc water right owned by the Applicant which can and will be <br />used in the court augmentation plan, unless a sufficient alternative replacement source is <br />identified and dedicated.
