<br />Notice of Proposed Decision <br /> <br /> <br />The Colorado Division of Reclamation, Mining and Safety has issued a proposed decision to Bond <br />Release Application No. 4 (SL-04) for the West Elk Mine, Permit No. C-1980-007. The <br />Underground operation is operated by Mountain Coal Company, LLC under the provisions of the <br />Colorado Surface Coal Mining Reclamation Act of 1979. The Partial Phase II Bond Release <br />application was submitted by Mountain Coal Company, LLC on October 3, 2011. The proposed <br />Partial Phase II Bond Release is for 67.6 acres for the successful replacement of topsoil and the <br />establishment of vegetation to control erosion to levels at or below the premining levels. The <br />Partial Phase II Bond release areas were reclaimed between 1996 and 2008 and include the Lone <br />Pine Gulch facilities area, the 2000 thermal event area and methane drainage well pads and roads <br />from nine different drilling areas. More detailed information regarding the release areas can be <br />found in the SL-04 application, on file at the Division’s Denver office. The Division is proposing <br />to release $196,037.00. The affected area is located in Delta and Gunnison Counties, <br />approximately 9 miles East of Paonia, Colorado. <br /> <br />Copies of the proposed decision are available for review at the Colorado Division of Reclamation, <br />Mining and Safety office, 1313 Sherman Street, Room 215, Denver, Colorado 80203, and on the <br />Division’s website at <br />http://mining.state.co.us/Reports/MiningData/Pages/ImagedDocumentData.aspx. Requests for a hearing must be made in writing within <br />thirty (30) days of the first publication of this notice, and shall state with reasonable specificity the <br />reasons for the request and objections to the proposed decision. <br /> <br />
