The Division finds the 2012 Annual Hydrology Report is in compliance of the following Rules:

Rule 4.05.13(4)(a) – The data compiled in the 2012 AHR is kept and maintained at the Foidel Creek Mine
office.

Rule 4.05.13(4)(b) – The 2012 AHR presents the hydrologic data and analysis resulting from the
Williams Fork Mines for the period of January 1, 2011 through December 31, 2012 as per the Williams
Fork Mine Permit.

Rule 4.05.13(4)(i), (ii), (iii) – The 2012 AHR identifies the water quality data obtained during the 2012
water year (January 1, through December 31). This includes data from each monitoring site. The AHR
included interpretation of the data and related impacts of the hydrologic balance.

Increase in conductivity was noted with wells TR-4, 81-01, 9 Mine and 259. Moffat County Mining, LLC
has stated it will continue monitoring these sites for more information on the conductivity trend being
observed. The Williams Fork Mines had one iron exceedance in the year of 2012. The exceedance was
documented in the fourth quarter discharge monitoring report. This iron exceedance is sporadic and is
observed to occur during very low flow time periods. The anomaly in total dissolved solids (TDS)
observed in 2008 has not occurred since. TDS values for the year 2012 are within the normal historical
average. No significant, unpredicted, or adverse environmental impacts were noted in Williams Fork
Mine’s 2012 Annual Hydrology Reports.

This concludes the Division’s review of the Williams Fork Mine’s 2012 Annual Hydrology Report. If you
have any questions, please feel free to contact me with any questions.

Sincerely,

Zach Trujillo
Environmental Protection Specialist
(303) 866-3567 ext. 8164
Zach.Trujillo@state.co.us
Office of Office of

Mined Land Reclamation Denver • Grand Junction • Durango Active and Inactive Mines
