In your e-mail you asked a number of
questions. I will attempt to answer your questions. I have included your questions in the body of this letter
in italics:

1. MWNW
When did EF begin monitoring MWNW and who permits it?

DRMS response: On page 9 of the Division’s “Groundwater Review related to Citizen’s Complaint”,
dated June 3, 2013, sent to all four parties of the Vento group on June 15, 2013, states;

“A former mine dewatering well known as the North Well was originally used to dewater abandoned
mine workings in the Red Arrow Coal Seam north of the main mine entries. EFCI discontinued its use
as a dewatering well in 1994, later removing the pump and associated equipment. In 2003, it was
converted to an approved [by the Division] for use as a monitoring well designated MW-NW.
However, MW-NW has been reported as dry since monitoring was initiated in early 2003.”

MW-NW is permitted with DRMS. The Division believes that monitoring wells also need to be
permitted with the Colorado Division of Water Resources (DWR) based on information provided by the
DWR.

2. Why did you and Kent decide to use a camera last year?

DRMS response: The Division conducted an inspection at the Southfield Mine, on April 17, 2012, “in
response to a citizen request under Rule 5.02.5 regarding possible damage or dysfunction of ground
water monitoring well MW-NW.” One of the Division’s recommendations at the close of the April 17,
2012 inspection was, “Consider the use of a borehole camera to investigate the well casing for the entire
depth of the well.”

Office of Office of

Mined Land Reclamation Denver • Grand Junction • Durango Active and Inactive Mines
