If you should choose to exercise your option to provide an engineering evaluation, as set forth in
paragraph (b) of the Structure Agreement, we ask that Ms. Wheeler be allowed to choose a local
engineering firm to complete the work. We are also concerned that the area delineated in your
application to DRMS as the permit boundary is wrong. As set forth in the DRMS letter of June
14, 2013, pursuant to Rule 3.1.12(2)(b), you are obligated to "place markers sufficient to
delineate the boundary of affected lands ", and not just the permit boundary of your operation.
If you should wish to discuss this matter further, please do not hesitate to contact me.
Sincerely,
/Susan C.
