Due to limited mining activity, we <br />would like to apply for Intermittent Status, which would start on our anniversary date of <br />August 5, 2013. Enclose are checks for a Revision Fee ($144.00) and the Annual Fee <br />($323.00). <br />Activity has been limited because it has not been economically practical for the Company <br />to pursue natural gas drilling in recent years. Current activity will consist of using <br />crushed shale from the borrow pit to maintain the two existing well pads and the access <br />roads. This work will is planned to occur intermittently from June until November each <br />year. <br />We have an active stormwater management permit through the Colorado Department of <br />Public Health and Environment, Certification No. for "Tepee Park Ranch <br />Exploration Project." Our stormwater management plan includes best practices for <br />stormwater control, weed control, and general site upkeep. <br />The borrow pit is on a small road cut adjacent to a private road on private property and <br />behind a locked gate. Due to the width of the road, the topography of the terrain, and the <br />instability of the surface, signs and boundary markers are not posted per Rule 3.1.12(1) <br />and (2). Per Rule 3.1.12(3) boundary, permit number, and operator name are available by <br />contacting the site owner, whose contact information is available at the nearby well pad <br />locations. <br />Attachment A includes diagrams for pre -mine topography, Mining - Current Conditions, <br />Mining Full Extent, and the Reclamation Plan. <br />Our existing Financial Warranty, Bond No. is adequate to cover any financial <br />liabilities.
