Pineda <br />5731 State Highway 13 Director <br />Meeker, CO 81641 <br />Re: Colowyo Coal Mine (Permit No. C- 1981 -019) <br />Bond Release Application No. 7 (SL -07), Second adequacy review <br />Dear Mr. McCourt: <br />DRMS staff reviewed your bond release application and the results of the inspection to determine <br />whether the items you have submitted in your application are adequate in terms of meeting the <br />requirements of the Act and Regulations. As you know, the following adequacy issues were identified: <br />1. Within parcel WP018, the area that contains a pile of rocks and a topsoil stockpile should be <br />removed from the bond release application. <br />2. Within parcel WP019, there is a scraper road that should be removed from the bond release <br />application. <br />3. The channels in WP019 (West Pit Fill Ditch and West Pit Coal Road Ditch) have not been <br />constructed, and should not be included in the application. <br />4. Also in WP019, the Division identified a topsoil stockpile near the western edge of the parcel, <br />but we were uncertain if any part of this topsoil stockpile is within parcel WP019. <br />I have reviewed your response to our adequacy review (letter from you dated 25 June 2013 and <br />associated materials), and I have concluded that the first three points were addressed with your re- <br />submittal. Based on a phone conversation with Tony Tennyson, I am confident that the topsoil <br />stockpile discussed in point 4 is outside of parcel WP019. <br />This concludes my adequacy review.
