Hickenlooper <br />Governor <br />Mike King <br />Executive Director <br />Loretta Pineda <br />Director <br />On July 1, 2013, the Division of Reclamation, Mining and Safety received your 110 to 112 Construction <br />Materials Reclamation Permit Conversion Application package for the Beeson Pit, Permit M1982 -186. <br />Preliminary review of the information received determined that the following items must be received before <br />the Division can consider your application as being submitted and technical review can begin: <br />APPLICATION FORM: The application form was received; however it was not fully completed. The <br />missing data will need to be filled in and the appropriate pages re- submitted. <br />REQUIRED EXHIBITS: As stated in section 1. 11.2 (3) of the construction materials rule (Contents of <br />conversion application) "...the operator shall provide all the information required by the Act and these rules <br />for the size of operation. However, the Operator need not supply any information required by the provisions <br />of the Act which has been previously supplied, unless such information is different from that in the original <br />application. However, the Applicant shall clearly describe where in the original application and supporting <br />documents the information not included in the conversion application, but necessary to render the <br />conversion application technically adequate, may be found." <br />In short, none of the exhibits listed in 6.4 of the rule have been provided, and no information from the <br />previous permit has been referenced. All required exhibits listed in section 6.4 of the construction materials <br />rule will need to be addressed and submitted for this application to be considered complete for review. <br />Your application will not be considered submitted until the information listed above is received and found <br />sufficient to begin our review. You have sixty (60) days from the above date to submit all necessary <br />documents that the Office needs for an application to be considered filed. If, at the end of the sixty day <br />period, the application has not been determined to be filed with the Office, the Office shall deny the <br />application and terminate the application file. <br />A decision date will be established 90 days from the date of receipt of all of the requested information. <br />Additionally, if you have already published notice you will need to republish notice, after the Division <br />considers the application submitted. This notice must be published once a week for four (4) consecutive <br />weeks, starting within ten (10) days of the date your application is considered submitted. We will notify you <br />when you should initiate republication of your notice. The final date for receiving public comments is the <br />Office of Office of <br />Mined Land Reclamation Denver • Grand Junction • Durango Active and Inactive Mines <br />
