RI:CU \-ERA` AGR1_ LAMENT <br />This RECOVERY AGREEMENT is entered into this 8 da} of /���;�� _ 2t�/ 3 by <br />and bei een the 1_Jnited States Fish and Wildlife Service (Service) and Trapper l41nino Inc <br />(Water User). <br />WHEREAS, in 19$8, the SecretarN of Interior. the Governors of Wyoming. Colorado and Utah, <br />and the Administrator of the Western Area l'ouer Administration signed a Cooperative <br />Agreement to implement the Recover -y Implementation Program for Endangered Fish Species in <br />the Upper C'oIorado River Basin (Recovery Program). and <br />WHFRFAS. the Recovery Program is intended to recover the endangered fish while providing <br />for crater development in the Upper Basin to proceed in compliance with state law. interstate <br />compacts and the lindangered Species Act; atld <br />WHEREAS. the Colorado Water Congress has passed a resolution supporting the Recover% <br />Program; and <br />'WHEREAS. on .lanuary 10, 2005. the Service issued a programmatic biological opinion (2005 <br />Opinion) nt2 the 11anc(g -e1 ent Plan n, Eluting- .Ted -b7shes in the EcHnIxt Rifer Bitlsin concluding,.: <br />that implementation of spec% #ted element` of the Recover' Action Plan (Recovert Elements). <br />alon4,t ,vith existing, and a specified amount of new depletions, are not likely to jeopardize the <br />continued existence of the endan -eyed fish or adversely modib, their critical habitat in the <br />Yampa Rimer subbasin and Green River subbasin downstreatn of the Yampa River confluence: <br />and <br />`L"I IEREAS. XN'ater User is the operator of Trapper- kline reclttestiri(I permit renewal (Water <br />Project), which causes or vvill cause depletions to the Yampa River subbasin; and <br />N % "IIEREAS. tki`ater User desires certainty that its, depletions can occur consistent with section 7 <br />and section 9 of the Endangered Species Act (ESA): and <br />WIIERI::1S. the Service desires a conimitinent h-onr t� ater User to the Reco -very 11rooram so <br />that the ProLrarn can ac:tualk be implemented to recover the endangered fish and to cam out till- <br />Recoverti Elements. <br />
