Proposed Decision <br />The Colorado Division of Reclamation, Mining and Safety proposes to APPROVE Trapper <br />Mining, Inc.'s application for permit renewal RN6. No additional permit area is proposed with <br />this renewal and the operational plan has not changed. Trapper submitted a conceptual plan and <br />updated the mining sequence for the next permit term (2013 — 2017). However, they are <br />preparing to submit a Permit Revision to update and provide details of the proposed plan. Also, <br />portions of haulroads, topsoil stripping areas and mining areas are projected for the next permit <br />term outside of the currently approved drainage and sediment control plan boundaries. Given <br />this, the Division proposed to approve the renewal application with the following stipulation: <br />Stipulation No. 21: <br />THE OPERATOR MUST SUBMIT AND RECEIVE APPROVAL FOR A PERMIT OR <br />TECHNICAL REVISION TO UPDATE THE DRAINAGE AND SEDIMENT CONTROL <br />PLAN PRIOR TO ANY DISTURBANCE OUTSIDE OF THE CURRENTLY APPROVED <br />DRAINAGE AND SEDIMENT CONTROL PLAN BOUNDARY. <br />This decision is based on a finding that the operations will comply with all requirements of the <br />Colorado State Program as found in the Colorado Surface Coal Mining Reclamation Act, C.R.S. <br />34 -33 -101 et seq., and the Regulations promulgated pursuant to the Act. <br />If no request for a formal hearing is made within thirty (30) days of the first publication of the <br />issuance of this proposed decision in the Craig Daily Press, then this decision becomes final. <br />The permit application, all supporting documentation, and any stipulations or conditions will <br />become a binding part of the permit. <br />Trapper Mine 4 July 9, 2013 <br />
