During RN6 Trapper made necessary updates to the threatened and endangered plant and <br />animal species portion of their permit (Sections 2.3.5 and 2.4.2). Only one change was <br />required for the Greater Sage- Grouse. These species was recently deemed by the USFWS a <br />candidate for threatened and endangered status. The Trapper Mine permit areas does not <br />encompass core habitat for the Greater Sage- Grouse and is unlikely to impact this species. <br />No impacts to any listed threatened or endangered species has been observed from past <br />mining activities at the Trapper Mine and none is projected. (2.07.6(2)(n)). <br />16. The Division has contacted the Office of Surface Mining, Reclamation Fees Branch. As of <br />this time, Trapper Mining, Inc. is current in the payment of reclamation fees required by 30 <br />CFR Chapter VII, subchapter R. (2.07.6(2)(0)). <br />Part B - Findings required by Rule 4 <br />The following findings and specific approvals are required by Rule 4. <br />Roads - Rule 4.03 <br />A. Haul Roads <br />Haul roads are discussed under Section 3.7.2, Vol. III of the permit application. <br />The Division has previously approved a temporary ford of an ephemeral or <br />intermittent stream having a watershed of at least one square mile during the <br />construction period, being that it will not alter normal water flow, contribute <br />sediment, or adversely affect fish or wildlife. All road construction occurs <br />upstream of adequate sediment control facilities. (4.03.1(2)(c)). <br />B. Access Roads <br />Access roads are discussed under Section 3.7.3, Vol. III of the permit application. <br />1. The Division previously approved fords of ephemeral streams in watersheds <br />of at least one square mile because they will not seriously alter normal water <br />flow, contribute to sediment load, or cause adverse affects to fish or wildlife. <br />The fords may occur when properly sized culverts are utilized. (4.03.2(2)(c)). <br />IL Support Facilities - Rule 4.04 <br />Support facilities are discussed under Section 3.8, Vol. III of the permit application. <br />A. Construction of support facilities will not result in damage, destruction, or <br />disruption of oil, gas, or water wells or pipelines, coal slurry pipelines, <br />railroads, or utility lines which pass over, under, or through the permit area. <br />Utility lines and a gas line pass through the permit area but are affected only <br />by the pit areas and not by any support facilities.
