PERMIT #: M- 2001 -046 <br />INSPECTOR'S INITIALS: PSH <br />INSPECTION DATE: June 28, 2013 <br />OBSERVATIONS <br />The Nix Sand & Gravel Mine was inspected by Peter Hays with the Division of Reclamation, Mining and Safety <br />(Division) as part of the Division's monitoring inspection program. Mr. Bill Timmons with Ready Mixed <br />Concrete Company was notified, but was unable to attend the inspection. The site was previously inspected <br />by the Division on March 30, 2011. <br />The Division holds a financial warranty in the amount of $317,000.00, which is adequate to reclaim the site <br />based on this inspection. The mine sign was observed and the boundaries were defined as required by Rule <br />3.1.12. <br />The Nix site is undisturbed by mining activity. The site is currently being used for agricultural purposes. The <br />site was driven from the north to south from Highway 66 to Weld County 28 along the interior access road. A <br />new oil and gas facility has been installed in the north section of the site and the overall oil and gas well <br />configuration differs from the approved Mine Plan Map for the site. The Operator will be required to update <br />the Mine and Reclamation Plan Maps in the future to accurately depict the wells at the site. <br />The Operator stated they still intend to submit an amendment to the approved permit to change the post <br />mining land use from general agriculture to developed water resource. The amendment must be approved by <br />the Division prior to the installation of the planned slurry wall at the site. <br />Photographs taken during the inspection are attached.
