Hickenlooper <br />Governor <br />Mike King <br />Executive Director <br />Loretta Pineda <br />Director <br />The Division of Reclamation, Mining and Safety (Division) received Oxbow Mining LLC's <br />( OMLLC) application for Technical Revision No. 74 (TR -74) at the Elk Creek Mine on June 3, <br />2013 and was deemed complete for the purposes of filing on June 7, 2013. OMLLC is proposing <br />to add 12 gob vent wells on 9 new well pads on the East Lease area. The Division has the <br />following comments regarding the proposed plan: <br />Gob vent boreholes GVB- LW- 25 -01, -24 -01 and -23 -01 are located along Elk Creek. It is <br />unclear from Drawing 2.05 -M1 Sheet 6 of 6 if the well pads will be constructed beyond the <br />stream buffer zone. Rule 4.05.18(1) states that no land within 100 feet of a perennial stream, an <br />intermittent stream or an ephemeral stream, with a drainage area greater than one square mile, <br />shall be disturbed by surface or underground coal mining operations. Please clarify that the gob <br />vent boreholes will be constructed beyond the stream buffer zone or submit additional <br />information, under this revision, that addresses Rule 4.05.18(1)(a), -(b) and (c). <br />2. The road used to access gob vent boreholes GVB- LW- 25 -01, -24 -01 and -23 -01 appears to cross <br />Elk Creek two times (Drawing 2.05 -M1 Sheet 6 of 6). What management practices will be used <br />to not cause additional contribution of suspended solids to streamflow (Rule 4.03.3(1)(b)? <br />The Division prepared a reclamation cost estimate for TR -74. The estimates includes the cost for 9 well <br />pads, 12 degas wells and 4.2 acres of access roads.
