NECC Response: <br />The date has been corrected. <br />6. Update text with correct NECC address. <br />NECC Response: <br />NECC's address has been corrected in section 2.04 text. <br />7. Update Table 4 and permit text narrative in section 2.04 regarding approved <br />disturbed acreage. <br />NECC Response: <br />Table 4 has been eliminated as this table would require constant update for any <br />revision that modifies acreage values. Text has been added to bring the acreage <br />up -to -date and to indicate how accurate information can be accessed at any point <br />in time. <br />8. Current T & E species list. <br />NECC Response: <br />The current T & E species information for both Las Animas county and the State <br />of Colorado has been added to Exhibit 16. <br />9. Permit text narrative regarding the Arkansas River speckled chub and darter and <br />water consumption at the mine. <br />NECC Response: <br />The mine was active in 1994 and is active now (absent the current temporary <br />cessation). NECC believes the statement is still accurate. A finding regarding T <br />& E species was made at the last permit renewal. NECC does not believe <br />additional findings regarding T & E species is required or warranted as a result of <br />the midterm review. <br />10. Text indicating limited impact to the Nysa roadside skipper. <br />NECC Response: <br />The permit text in question seems to say "only one insect potentially exists in the <br />area." The Nysa roadside skipper is not a T & E species. It could be that this <br />insect was a concern at one time but it is not clear what the reason was to include <br />permit text regarding this insect. NECC proposes to leave the text unchanged at <br />this time.
