PUBLIC NOTICE
<br />New Elk Coal Company, LLC, 12250 HWY 12, Weston, CO 81091 the operator of the
<br />New Elk Mine, Permit number C -1981- 012, is filing for a technical revision (TR- 68) to
<br />the mining permit with the State of Colorado, Division of Reclamation Mining and Safety.
<br />For filing purposes this application was deemed complete by the Division on MONTH
<br />DAY, YEAR.
<br />The New Elk Mine is located approximately 7 miles west of Weston Colorado on State
<br />Hwy. 12. The Jansen Yard is located immediately south of the town of Jansen. The mine
<br />permit boundary is located within sections 13, 14, 21, 22, 23, 24, 25, 26, 27, 28, 34, 35,
<br />and 36 T33S R68W and sections 1 and 2, T34S, R68W. The Jansen Yard is located
<br />within sections 22 and 23, T33S, R64W. The combined permit boundary contains 4198.9
<br />acres more or less. These sections can be located on the USGS 7.5 minute Vigil,
<br />Stonewall, Tercio, and Trinidad quadrangle maps. Portions of the proposed underground
<br />mine and surface support of the underground mine lie within the boundary of the Bosque
<br />del Oso State Wildlife Area. A total of 219.4 acres of surface disturbance from mining
<br />related activity is covered by a reclamation bond in the amount of $4,133,1 37.02 as of
<br />March 13, 2012.
<br />This technical revision addresses issues raised by the Division in the 2012 Midterm
<br />Review of the permit application. Issues addressed include, but are not limited to, permit
<br />cleanup of existing text, updating licenses and permit, map corrections, topsoil balance,
<br />prime farmlands, changes to the revegetation plan, permanent impoundments, and
<br />revision and update of the reclamation cost estimate.. Permit text has also been re-
<br />formatted in anticipation of submitting future revisions in an electronic format.
<br />A copy of the proposed revision is available for public inspection at the Las Animas
<br />County courthouse, Office of the County Recorder, and at the offices of the Division of
<br />Reclamation Mining and Safety, 1313 Sherman St., Room 215, Denver, CO, 80203,
<br />(303) 866 -3567. Written comments regarding this application may be submitted to, and
<br />additional information may be obtained from, the Division of Reclamation Mining and
<br />Safety at the above address. Written comments must be received by the Division of
<br />Reclamation, Mining and Safety within 10 days, after the date of this publication in order
<br />to be considered.
