Page 2 of 3 <br />EA for the proposed Federal Coal Exploration Plan. Upon approval of the Federal Coal <br />Exploration Plan from the BLM including a Decision Memo of the Federal Coal <br />Exploration Plan from the USFS, Please submit the approved Federal Coal Exploration <br />Plan and the Decision Memo of the Federal Coal Exploration Plan from the USFS for <br />review. <br />This information was received via email through a link to the decision records from the <br />BLM and in an email from Mr. Ryan Taylor of the USFS providing a concurrence letter <br />from the USFS to the BLM Decision. <br />2. Rule 2.02.2(2)(h) —The submitted ROD for the FEIS associated with the COC -1362 and <br />COC -67232 modifications states that, "Compliance with terms and conditions of the <br />Biological Opinion are addressed in lease stipulations for threatened and endangered <br />species... Appendix A of this BLM ROD." The referenced Appendix was not included in <br />the ALC submittal. Please submit a copy of FEIS ROD Appendix A for review. <br />The Division has received and reviewed the copy of the FEIS ROD Appendix A. <br />If it is the intention of ALC to utilize the results of the Federal Coal Exploration Plan EA <br />for compliance of Rule 2.02.2(2)(h), Please submit the results of the EA to the Division <br />for review. If ALC wishes to provide information satisfying Rule 2.02.2(2)(h) other than <br />the EA, Please submit a statement with appropriate references from the relevant State and <br />Federal agencies which determines that the exploration and reclamation will not <br />jeopardize the continued existence of an endangered or threatened species or result in the <br />destruction or adverse modification of critical habitat of those species. <br />This comment was addressed through the EA associated with the approval of the decision <br />of the Sunset Trail Exploration Plan. <br />3. Rule 2.02.2(2)(g) — The NOI lists Attachment No. 3 USFS Special Use Road Permit, <br />This attachment was not included in the NOI submittal. Please submit the approved <br />USFS Special Use Road Permit for review. <br />ALC submitted Attachment No. 3 — The USFS Special Use Road Permit. <br />Additional completeness comments: <br />4. Based on a review of the light -use roads proposed under NOI X- 2013 - 228 -01, the <br />locations of the roads appear to cross identified intermittent streams. Per Rule(s) <br />4.21.4(3)(b), Please provide information discussing the process in which ALC proposes <br />to control and minimize water pollution for the exploration operations and any and all <br />designs or models which support ALC's plan. <br />Per the request of the surface owner, USFS, and per Rule 4.03.3(3) temporary light -use <br />roads will be designed in the field. The person to conduct the coal exploration commits <br />to provide road designs as required in the 180 -day report of the coal exploration activity. <br />
